These terms apply to all tree surgery, hedge, fencing and turfing work carried out by Evergreen Tree Care ("we", "us") for a customer ("you"). By accepting a written quote from us, you agree to these terms.
1. Quotes and pricing
Quotes are provided free of charge following a site visit or, where a site visit isn't practical, based on the information and photos you supply. Quotes are valid for 30 days unless stated otherwise. We work either on a fixed price for a defined scope of work or on an agreed day rate for open-ended clearance or storm work. Any material change in scope will be re-quoted before extra work starts.
2. Booking and access
Work is booked in when you confirm the quote in writing (email or text is fine). You are responsible for providing safe, reasonable access to the trees, and for informing anyone else on site (family, tenants, neighbours) that the work is happening.
3. TPOs and Conservation Areas
Where a tree is protected by a Tree Preservation Order or sits within a Conservation Area, work cannot start until the relevant application or notification has been dealt with by the local authority. We will prepare and submit paperwork on your behalf. Statutory response periods are outside our control.
4. Waste
All arisings are removed under our Environment Agency waste carrier registration, unless you have asked us to leave logs or chip on site. Waste removal is included in your quote unless stated otherwise.
5. Guarantee
We provide a general workmanship guarantee on every job we complete. If something isn't right after we've left, contact us and we will return to put it right at no additional cost. The guarantee covers workmanship, not natural biological changes to a tree (die-back, disease, secondary growth) or damage caused by later weather events.
6. Insurance
We carry public liability insurance appropriate to our work. Evidence of cover can be provided on request.
7. Payment
Payment is due on completion of the work unless agreed otherwise in writing. We accept card, cash and bank transfer. Late payment may attract statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.
8. Cancellation
You may cancel a booking at any time by contacting us. If we have already incurred costs (permits, materials, plant hire) we may pass those on. We may also cancel or postpone work where weather or safety conditions make it unsafe to proceed.
9. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for anything else that cannot be limited by law. Otherwise, our total liability for any job is limited to the price paid for that job.
10. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be dealt with by the courts of England and Wales.
